Terms of Service — ReleaseGlow

1. Acceptance of Terms

By accessing or using ReleaseGlow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

ReleaseGlow provides a product communication platform that enables users to:

Create and manage product changelogs with AI assistance
Display in-app announcements to end users
Send automated email digests to subscribers
Embed widgets in their applications
Access related features and functionality

3. User Accounts and Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password and account
Accept all responsibility for activity under your account
Notify us immediately of any unauthorized use of your account

You may not use another person's account without permission. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. Subscription Plans and Billing

ReleaseGlow offers different subscription plans (Free, Starter, Pro, Enterprise):

Billing Cycles: Subscriptions are billed monthly or annually in advance.
Payment: You must provide valid payment information. By subscribing, you authorize us to charge your payment method.
Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date.
Price Changes: We may change prices with 30 days' notice. Changes apply to renewals after the notice period.
Taxes: All prices are exclusive of taxes. You are responsible for applicable taxes.
Currency: All payments are in USD unless otherwise agreed.

5. Free Trial

The Free plan is available without time limits and does not require payment information. Upgrading to a paid plan requires valid payment information. We reserve the right to modify or discontinue the Free plan with reasonable notice.

6. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until the end of the paid period.

Refunds: We offer a 14-day money-back guarantee on all paid plans. To request a refund, contact us within 14 days of your initial payment. Refunds are not provided for renewals or partial billing periods.

7. User Content and Data

Your Content: You retain all rights to content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely to provide the Service.

Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent that you own or have necessary rights to your User Content.

Data Deletion: Upon account deletion, your data will be deleted within 30 days, except where we are required to retain it for legal or compliance purposes.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by ReleaseGlow and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks may not be used without our prior written permission. All other trademarks appearing on the Service are the property of their respective owners.

9. Prohibited Uses

You agree not to use the Service:

In any way that violates any applicable national or international law or regulation
To transmit any unsolicited or unauthorized advertising or promotional material
To impersonate or attempt to impersonate ReleaseGlow, another user, or any other person
To engage in any activity that interferes with or disrupts the Service
To attempt to gain unauthorized access to any portion of the Service
To upload viruses or malicious code
To collect or track personal information of others without consent
To spam, phish, or scrape data
For any automated use without our express written permission

10. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be available at all times. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We are not responsible for any delays, delivery failures, or other damage resulting from such problems. We reserve the right to modify or discontinue the Service with reasonable notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RELEASEGLOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless ReleaseGlow and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We will make reasonable efforts to notify you of significant changes. You agree that ReleaseGlow shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of France. You consent to the personal jurisdiction of such courts.
